Terms & Conditions of Sale

1. About These Terms

These Terms & Conditions of Sale apply to products and services purchased from Shaeo Group Pty Ltd (ACN 695 939 827) ("Shaeo Group", "we", "us" or "our"), including purchases made through our online store.

By placing an order with Shaeo Group, you agree to these Terms & Conditions to the extent permitted by law.

Customers purchasing through an approved Shaeo Group credit account are also subject to the separate Shaeo Group Credit Application and Terms & Conditions accepted when establishing their account.

Where applicable, your rights under the Australian Consumer Law continue to apply.

2. Products & Services

Shaeo Group supplies a broad range of products and services including tools, industrial products, hydraulic and pneumatic components, fire and safety equipment, workshop equipment, automotive products, consumables, procurement and compliance-related services.

Our online store represents only part of the products we can supply.

We may be able to source the product through our wider supplier network.

3. Product Information

We make reasonable efforts to ensure product descriptions, specifications, images and other information displayed on our website are accurate.

Product images may be for illustrative purposes and packaging, appearance, specifications or supplied accessories may change from time to time.

If a particular specification is critical to your application, please contact us before ordering.

It is the customer's responsibility to ensure that products ordered are suitable for their intended application.

4. Pricing

Unless otherwise stated, prices displayed through our Australian online store are in Australian Dollars (AUD) and include GST where applicable.

Prices may change without notice.

While we make reasonable efforts to ensure pricing is correct, errors may occasionally occur.

If a material pricing or product information error affects an order, we will contact you before proceeding where reasonably practicable.

5. Quotations

Unless otherwise specified, quotations issued by Shaeo Group are valid for 30 days from the date of issue.

During that period and before acceptance, a quotation may need to be amended or withdrawn where there has been a material change in cost, availability or another factor outside our reasonable control.

Where this occurs, we'll communicate the change and provide a revised quotation where appropriate.

6. Orders & Product Availability

All orders are subject to product availability.

Shaeo Group maintains local stock across a growing range of products; however, not every product displayed online is necessarily held in stock at all times.

Some products may be sourced from our suppliers after an order is placed.

If there is an unexpected stock issue, significant delay or other problem fulfilling your order, we'll contact you to discuss the available options.

If you require a product urgently, please contact us before ordering so we can check current availability.

7. Payment

Online orders must be paid using one of the payment methods made available during checkout unless otherwise agreed.

Approved credit-account customers are subject to their agreed account terms and the Shaeo Group Credit Application and Terms & Conditions.

Unless otherwise agreed by Shaeo Group, approved credit-account invoices are payable in accordance with the payment terms applicable to that account.

8. Delivery & Freight

Shaeo Group offers a range of delivery and freight options depending on the products ordered and delivery location.

Perth metropolitan delivery is available for a small fee, subject to location, product size, weight and delivery requirements.

We can also arrange freight to regional Western Australia and locations throughout Australia where suitable.

Delivery, freight, packaging, insurance, dangerous goods handling or other applicable transportation charges may be additional to the purchase price.

Any delivery timeframe provided is an estimate unless Shaeo Group has expressly agreed to a specific timeframe in writing.

Large, heavy, specialised or dangerous goods may require individual freight arrangements.

9. Collection

Collection is available by arrangement for smaller parts and orders.

Customers must wait until Shaeo Group has confirmed that an order is ready before arriving for collection.

Some larger, bulky or specialised products may not be suitable for collection.

Please contact us if you're unsure whether collection is available for your order.

10. Inspection of Goods

Customers should inspect their order as soon as reasonably practical after receiving it.

If goods:

  • Arrive damaged;
  • Appear faulty or defective;
  • Don't match the product ordered;
  • Don't match an agreed description; or
  • Have been supplied in an incorrect quantity,

please contact Shaeo Group as soon as possible.

Where practical, we ask customers to notify us within 7 days of receiving the goods so that we can investigate the issue promptly.

Please provide your order or invoice number and photographs where relevant.

This timeframe does not exclude or limit any rights that cannot lawfully be excluded.

11. Returns

Please contact Shaeo Group before returning any product.

The appropriate return process will depend on the product and reason for return.

Products should not be returned without first contacting our team.

12. Change of Mind

Change-of-mind returns are subject to approval by Shaeo Group.

Where accepted, products generally need to be:

  • Unused;
  • In new and resalable condition;
  • Complete with original accessories and components;
  • In original packaging; and
  • Accompanied by proof of purchase.

Delivery and return freight costs associated with an approved change-of-mind return may be the customer's responsibility.

13. Special Orders & Sourced Products

Shaeo Group specialises in sourcing products for individual customer requirements.

Products that are specially ordered, custom-made, configured, manufactured, cut to length or sourced specifically for a customer may not be eligible for a change-of-mind return where our supplier does not accept the product back.

We encourage customers to carefully check part numbers, measurements, specifications and quantities before approving special-order products.

If you're unsure, ask us before ordering. We're here to help.

Nothing in this section excludes rights or remedies that cannot legally be excluded.

14. Faulty Products & Warranty

If you believe a product is faulty, please contact:

Please provide your order or invoice details, product information and a description of the issue. Photos or videos may also assist us with assessing the enquiry.

Many products supplied by Shaeo Group are also covered by manufacturer warranties.

Where applicable, we'll assist with the relevant supplier or manufacturer warranty process.

Manufacturer warranties operate in addition to rights that may apply under Australian law.

15. SP Tools Warranty Support

Shaeo Group is an SP Tools stockist.

We're happy to assist customers with SP Tools product and warranty enquiries.

If you believe you have an SP Tools warranty issue, contact us with details of the product and fault.

Even if your SP Tools product was originally purchased elsewhere, you're welcome to approach Shaeo Group for assistance with the warranty process.

16. Product Sourcing

Can't find what you're looking for?

Give us a challenge.

Customers can send us a part number, photograph, specification, drawing, equipment details or description of what they require.

We'll use our supplier network to investigate suitable products and availability.

While we'll always do our best to assist, product sourcing is subject to manufacturer and supplier availability and we cannot guarantee that every requested product will be available.

17. Delays & Events Outside Our Control

Shaeo Group will make reasonable efforts to fulfil orders within estimated timeframes.

However, delays can occur due to circumstances outside our reasonable control, including supplier delays, freight disruptions, product shortages and other events affecting supply or transportation.

Where we're aware of a significant delay affecting your order, we'll endeavour to keep you informed.

18. Liability

To the extent permitted by law, Shaeo Group's liability in connection with the supply of goods may be limited to an applicable remedy such as:

  • Replacement of the goods;
  • Supply of equivalent goods;
  • Repair of the goods;
  • Payment of the reasonable cost of replacement or equivalent goods; or
  • Payment of the reasonable cost of having the goods repaired.

Shaeo Group will not be responsible for loss resulting from misuse, incorrect installation, failure to maintain a product, use outside its intended application, continued use after a defect becomes apparent, failure to follow manufacturer instructions, fair wear and tear or circumstances outside our reasonable control, to the extent permitted by law.

Nothing in these Terms & Conditions excludes, restricts or modifies a right or remedy that cannot lawfully be excluded.

19. Approved Credit Accounts

Business customers may apply for a Shaeo Group credit account.

Credit accounts are subject to approval and may be subject to a credit limit, credit assessment and additional requirements.

Approved credit-account customers are bound by the separate Shaeo Group Credit Application and Terms & Conditions, including the payment, default, security, PPSA and other provisions contained within that agreement.

Where you're purchasing using an approved credit account, the Credit Application and Terms & Conditions should be read together with these website terms where applicable.

20. Privacy

Shaeo Group handles personal information in connection with orders, enquiries and customer accounts.

Information may be used where reasonably necessary to process orders, provide goods and services, manage customer accounts, communicate with customers and meet applicable legal and regulatory obligations.

21. Governing Law

These Terms & Conditions are governed by the laws in force in Western Australia.

To the extent permitted by law, the parties submit to the jurisdiction of the courts of Western Australia.

22. Changes to These Terms

Shaeo Group may update these Terms & Conditions from time to time.

The Terms & Conditions applicable to an order will generally be those published or otherwise agreed at the time the relevant transaction is entered into, subject to applicable law.
